By renting, ordering, accepting delivery of, or using a dumpster or related waste-removal service from Upstate Dumpsters, the customer acknowledges that they have read, understood, and agree to be legally bound by these Terms of Service and Customer Agreement.
If the Customer is a contractor, property manager, business, or other person arranging dumpster rental or waste-removal services on behalf of another person or entity, the Customer represents and warrants that they have authority to accept these Terms on behalf of that person or entity. The contractor or other ordering party agrees that these Terms apply to both the ordering party and the client for whom the service is being arranged.
1. Acceptance of Terms
Rental of a dumpster constitutes Customer's acceptance of these Terms. Customer's acceptance may occur by placing an order, making payment, authorizing delivery, accepting delivery of the dumpster, using the dumpster, or otherwise accepting Company's services.
These Terms constitute an agreement between Customer and Company and govern all dumpster rental and waste-removal services provided by Company unless the parties have expressly agreed otherwise in a written document signed by Company.
2. Mattresses and Box Springs
Mattresses and box springs are subject to an additional disposal charge of $50 per piece when declared in advance.
Any mattress or box spring that was not disclosed to Company before pickup or disposal is subject to a charge of $75 per piece.
3. Tires
Tires are subject to an additional disposal charge of $65 per tire when declared in advance.
Any tire that was not disclosed to Company before pickup or disposal is subject to a charge of $75 per tire.
4. Prohibited and Hazardous Materials
Customer shall not place or allow any prohibited material in the dumpster.
The following materials are not accepted, including but not limited to:
Liquids;
Hazardous materials;
Chemicals;
Paints;
Asbestos-containing materials;
Batteries; and
Any other waste prohibited by applicable federal, state, or local law.
Customer is solely responsible for ensuring that all materials placed in the dumpster are lawful and acceptable for disposal.
If prohibited, hazardous, or unlawful materials are discovered, Customer may be responsible for all resulting costs, fees, damages, disposal charges, transportation expenses, fines, penalties, cleanup costs, and other expenses to the extent permitted by law.
5. Weight, Height, and Load Requirements
Customer is responsible for loading the dumpster safely and within Company's applicable weight and height requirements.
Overweight or over-height dumpsters may be subject to additional charges.
If Company determines that a load is unsafe, unlawful, or otherwise unsuitable for transportation, Company may refuse to haul the dumpster and may require Customer to remove or correct the excess or prohibited material before the dumpster is transported.
Company may leave excess debris behind when hauling the material would be unsafe, unlawful, or otherwise prohibited.
Customer remains responsible for all applicable rental, transportation, disposal, overweight, over-height, cleanup, or other charges resulting from Customer's load.
6. Driveways and Property Damage
Customer is responsible for providing and properly placing adequate wood, boards, or other suitable protection for any driveway or surface where the dumpster will be placed or accessed when such protection is necessary.
To the extent permitted by law, Customer assumes responsibility for damage to a driveway or other surface resulting from Customer's failure to provide appropriate protection.
Customer is also responsible for property damage arising from any location, route, driveway, surface, structure, or access point that Customer directs or instructs Company to use, to the extent permitted by applicable law.
Customer represents that Company has been provided with accurate information regarding the property and any access conditions relevant to delivery, placement, and pickup.
7. Access and Missed Trips
Customer must ensure that Company has safe and unobstructed access to the dumpster for delivery, service, and pickup.
If Company is unable to complete a scheduled delivery, pickup, exchange, or other trip because of blocked access or another condition not caused by Company, Customer may be charged a trip charge of up to 50% of the applicable dumpster rental price.
Examples include, without limitation, vehicles, equipment, debris, gates, structures, unsafe conditions, inaccessible locations, or other obstructions that prevent Company from safely completing the requested service.
8. Payment and Collection Charges
Customer agrees to pay all charges associated with the rental and disposal services in accordance with the agreed pricing and payment terms.
Any invoice that remains unpaid for more than 15 days may be subject to a 25% collections fee, to the extent permitted by applicable law, in addition to the outstanding balance and any other lawful collection costs.
Customer agrees to pay all amounts properly due under these Terms.
9. Customer Responsibility
Customer is responsible for the contents of the dumpster from the time of delivery until pickup, including ensuring that no prohibited, hazardous, or unlawful materials are placed inside.
Customer is also responsible for complying with all applicable laws, regulations, property rules, and disposal requirements.
10. Contractor and Third-Party Rentals
If a contractor, property manager, or other third party rents a dumpster for a client or another person, the person placing the order agrees to these Terms on behalf of the client and represents that they have authority to do so.
The ordering party remains responsible for ensuring that the client is informed of these Terms and for all charges and obligations arising from the rental to the extent permitted by law.
11. Right to Refuse Service
Company reserves the right to refuse delivery, pickup, transportation, or disposal of any dumpster or material when Company reasonably determines that the service or load would violate applicable law, create an unsafe condition, damage property, exceed applicable limits, or otherwise create an unacceptable risk.
12. Agreement and Acknowledgment
BY RENTING, ORDERING, ACCEPTING DELIVERY OF, OR USING A DUMPSTER FROM COMPANY, CUSTOMER ACKNOWLEDGES THAT CUSTOMER HAS READ THESE TERMS, UNDERSTANDS THEM, AND AGREES TO BE BOUND BY THEM.
Customer's acceptance of the dumpster rental or use of Company's services constitutes acceptance of these Terms.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
